These Terms of Use ("Terms") govern your access to and use of Altai ("we," "us," or "our"), an AI-powered photo and video editing mobile application. By accessing or using our app, you agree to be bound by these Terms.

## Acceptance of Terms

By downloading, installing, or using Altai, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our app.

## Description of Service

Altai is an AI-powered photo and video editing application that allows users to transform and enhance their images and videos using artificial intelligence technology. Our services include:

- AI-powered photo editing, enhancement, and transformation
- AI-powered video generation and effects using Veo 3.1
- AI chat assistant for creative guidance
- Image transformation and generation
- Credit-based usage system
- User account management

## User Accounts and Registration

### Device-Based Access
- Our app uses device identification for user management
- A unique device ID is automatically generated on first launch
- Each device may be associated with one user account
- Account access is limited to the registered device
- No username, password, or email registration is required

### Account Security
- You are responsible for maintaining access to your registered device
- Account data is tied to your device and cannot be transferred without contacting support

## Credit System and Purchases

### Credits
- The app operates on a credit-based system
- Credits are required for AI generation features:
  - **Image generation:** 1 credit per image
  - **Video generation (Veo 3.1):** 10 credits per video
- Credit purchases are processed through the App Store (iOS) or Google Play (Android)

### Purchase Terms
- All credit purchases are final and non-refundable except as required by applicable law
- Prices and credit amounts are subject to change without notice
- We reserve the right to modify or discontinue credit offerings

### Refund Policy
- **Image generation:** Credits are refunded if the AI generation fails
- **Video generation:** Credits are **NOT refunded** even if generation fails. Credits are deducted immediately when the job is created, before the AI API is called
- Purchased credit packages follow the refund policies of the App Store and Google Play

## Acceptable Use Policy

You agree to use Altai only for lawful purposes and in accordance with these Terms. You agree NOT to:

- Use the app for any illegal or unauthorized purpose
- Upload, share, or process inappropriate, offensive, harmful, or illegal content
- Generate deepfakes, misleading content, or content that impersonates real individuals without consent
- Attempt to reverse engineer, decompile, or disassemble the app
- Use automated systems or bots to access our services
- Circumvent or manipulate the credit system
- Violate any intellectual property rights of others
- Use the service to harass, threaten, or harm others

## Content and Intellectual Property

### Your Content
- You retain ownership of the images and videos you upload
- By uploading content, you grant us a limited license to process and temporarily store your files for the purpose of providing the service
- We do not claim ownership of your original content
- You are responsible for ensuring you have the rights to upload and modify any content

### AI-Generated Content
- AI-generated content is produced by third-party AI models (Google Gemini AI / Veo 3.1)
- You may use AI-generated content for personal purposes
- We do not guarantee exclusive rights to AI-generated outputs
- You should not use AI-generated content to mislead or deceive others

### Our Intellectual Property
- Altai, its logos, app design, and all related intellectual property are owned by us
- You may not reproduce, distribute, or create derivative works of our intellectual property without written permission

## Privacy and Data Protection

Your privacy is important to us. Please review our [Privacy Policy](./PRIVACY_POLICY.md), which also governs your use of Altai, to understand our practices regarding your personal information.

## Disclaimers and Limitations

### Service Availability
- We strive to provide reliable service but cannot guarantee uninterrupted access
- AI generation features depend on third-party AI services and may experience outages
- We reserve the right to modify, suspend, or discontinue any part of our service

### AI Content
- AI-generated content is provided "as is" without warranties of any kind
- Results may vary based on input quality, prompt, and AI processing
- We do not guarantee specific outcomes, quality, or accuracy of results
- AI-generated content may not always be appropriate or accurate

### Limitation of Liability
- Altai is provided "as is" without warranties of any kind, express or implied
- We shall not be liable for any indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the amount paid by you for credits in the 12 months preceding the claim

## Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of Altai, your violation of these Terms, or your violation of any rights of another party.

## Termination

We may terminate or suspend your access to Altai immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the app will cease immediately.

## Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted. Continued use of Altai after changes constitutes acceptance of the new Terms.

## Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
